ATS Derabassi Disconnects Power Supply of Residents.

Speaking to News Online Capt. Sanjay Kashyap mentioned that ATS has Illegally  disconnected the power back up supply during lockdown period

This has resulted in huge harassment to the Residents of ATS lifestyle Derabassi. During the lockdown where most of the builders going out of the way to support their residence the step ATS in the Lockdown has taken is highly condemned.

Capt. Sanjay Kashyap also mentioned to News News online that they have already moved a complaint to Punjab RERA Authorities and filed a case in Rera court against ATS builder for the illegal imposition of monthly maintenance charges.

It is well to be mentioned that the ATS project is still under construction and the builder is yet to obtain OC and CC from the competent authority. The builder had disconnected power back up supply on 3/05/2020 of the residents.

It may be informed that residents at the time of sale of flats, the builder had promised a number of amenities and full payment has been paid for such amenities long back. Builder without providing amenities and obtaining OC and CC imposed monthly maint charges w.e. f June 2019.

Residents objected to the imposition of monthly maintenance charges for the under-construction project as the facilities like clubhouse, swimming pool, approach road, shopping complex, conversion of Ganda Nala in a water body, etc.  as detail in the enclosed brochure has not been made available till date.

Some of the residents moved Pb Rera court to seek justice against imposing illegal monthly maint charges for under-construction projects.

Request to wait for the Pb Rera verdict has also been ignored by ATS for the reason best known to ATS. Even clause16 of the buyer’s agreement is not honored in which OC and CC are required to be obtained before registration and signing of the maintenance agreement. Builder managed to get maint. The agreement signed cleverly unlawfully without obtaining OC and CC at the time of possession of flat.

Promised amenities, for which payment has been made long back, have also not been provided till date. Under the above circumstances, instead of Compensating for the deficiency on the part of the builder, disconnected power back up supply arbitrarily and illegally. Disconnection of power back up supply for which each resident has paid Rs 1.00 lac and paying power consumption charges@rs 22/-per KWH regularly, is illegal.  The above rate is highest in the region.

The matter was also brought in the notice of administration but no action has taken for the restoration of power back supply.

Residents, who are mostly senior citizens, are being harassed, particularly during lockdown period by the builder despite the pendency of case challenging the imposition of monthly maintenance charges for the under-construction project which doesn’t have OC and CC

Residents whose power back up supply has been disconnected had deposited an advance payment towards power back up supply of Rs 1.00 lac. Such residents have demanded a refund of the same along with 18% interest from the date of payment to enable residents to arrange alternative sources.

It may be made clear that’s Power back up system has been installed with the advance payment of Rs one lac each contributed by all the residents and all the residents has the right to avail this power back up supply.

Residents are waiting for the lifting of lockdown and functioning of Pb Rera court for relief as ATS knowingly harassing residents despite the matter being sub judice. Kindly be advised that the project sold in this region at the highest rate for such services and amnesties advised by ATS representatives and advertised vouchers.
