Retired Since 1993 Former Faridabad Officer Finally Gets Relief as High Court Orders Release of Dues
The Punjab and Haryana High Court got angry with the Faridabad Municipal Corporation for delaying the retirement benefits of a Zonal Taxation Officer for more than thirty years. The court said that the retired official had to live with uncertainty all these years. They described the delay as a worry that was always hanging over him.
The officer retired on June 30 1993.. His pension and other benefits were pending because of some disciplinary issues that started before he retired. Even though the charges against him were dropped years ago because it took long to investigate the corporation still didn’t give him his dues.
When the court heard the case they noted that the retired officer spent over thirty years trying to get what was legally his. The court also said that he was already cleared in the criminal case. So there was no reason to delay his pension and other payments.
The Municipal Corporation said that some recoveries were pending, like advances and house rent.. The court found no evidence of any outstanding amount. They said that the deductions made from his pension were not justified.
The High Court ordered the Faridabad Municipal Corporation to give the officer all his pending retirement benefits within two months. They also said that the corporation must refund the money deducted from his pension and pay 6% interest on the delayed amount.
The court stressed that retirement benefits are a persons right and cannot be delayed without a reason. They observed that unnecessary delays, by the administration caused the retired officer a lot of trouble and mental stress.
