The Punjab and Haryana High Court has directed the Haryana urban authority to restore the allotment of a plot after examining a dispute related to encroachment and cancellation of ownership rights. The court’s order has brought relief to the petitioner, who had challenged the decision taken by the authorities regarding the property.
The matter was related to a plot whose allotment was cancelled after allegations of encroachment were raised. The petitioner argued that the action taken by the department was not justified and that proper procedures were not followed before cancelling the allotment.
After hearing both sides, the High Court observed that the authorities must follow fair procedures while dealing with property matters. The court directed the concerned urban development body in Haryana to restore the allotment and reconsider the case as per legal provisions.
The decision highlights the importance of due process and protection of property rights while handling disputes involving government-allotted plots. The court also emphasized that administrative decisions should be supported by proper reasoning and legal compliance.
The order is expected to impact similar cases where property allotments are cancelled due to alleged violations or encroachments. The Haryana urban authority will now have to take necessary steps to implement the court’s directions.
The ruling has once again underlined the role of judicial review in ensuring fairness and accountability in administrative decisions related to land and property.
